GENERAL CONDITION OF SALES
These conditions are valid between the company Magnetall surl with Operational Headquarters and Mail Delivery: via Caproni 11E/20 Zona Ind.le 38068 Rovereto (TN) - Registered Office: via Durini 9, 20121 Milan VAT Number 10093720158 Fiscal Code 00633430228 REA 1340443 Reg. Imprese 00633430228 and any person who makes purchases hereinafter referred to as the ''Customer''. These conditions may be subject to modifications and the date of publication of the same on the site is equivalent to the date of entry into force. These conditions govern purchases made on the site www.magnetall.it, in accordance with the provisions of Legislative Decree no. 206/2005, amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003.
Object of the contract
With these general conditions of sale, Magnetall sells and the Customer purchases. In the order confirmation email, the Customer will also receive the pdf to download and archive a copy of these general conditions of sale, as required by art. 51 paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.
Conditions of supply
Unless otherwise specified, the goods will be shipped within 1-10 working days from receipt of payment. In the case of payment on delivery, they will be shipped within 1-10 working days from sending the order confirmation.
Pre-contractual information for the consumer – art.4 of Legislative Decree 206/2005
Before concluding the purchase contract, the Customer examines the characteristics of the items that are illustrated in the individual product sheets at the time of choice by the Customer. By placing an order, the Customer transmits a binding offer to enter into a contract. However, the purchase contract is only concluded when we send an order confirmation by email. The Customer will receive, at the address indicated, an order confirmation with all the data relating to the order and our general conditions of sale. Before confirming the order with "obligation to pay", the Customer is informed of:
total price of the goods including taxes, with details of shipping costs and any other costs;
payment methods;
the deadline by which Magnetall undertakes to deliver the goods;
conditions, terms and procedures for exercising the right of withdrawal as well as the standard withdrawal form referred to in Annex I, Part B of Legislative Decree 21/2014;
information that the Customer will have to bear the cost of returning the goods in the event of withdrawal;
existence of the legal guarantee of conformity for the goods purchased;
after-sales assistance conditions and commercial guarantees provided by Magnetall.

Conclusion of the contract
The sales contract is considered concluded with the sending by Magnetall to the Customer of an order confirmation email. The email contains the Customer's data and the order number, the price of the purchased goods, the shipping costs and the delivery address to which the goods will be sent and the pdf to be able to print and archive the copy of these conditions. The Customer undertakes to verify the accuracy of the personal data contained in the above email and to promptly communicate to Magnetall any corrections/modifications to be made. Magnetall undertakes to describe and present the items on the site in the best possible way. Nevertheless, some errors may be highlighted. The photographs of the products presented on www.magnetall.it are to be considered representative. Magnetall undertakes to deliver the goods within 1-10 days from the sending by Magnetall of the order confirmation email to the Customer.
Payment Methods
Each payment by the Customer may be made by advance bank transfer or cash on delivery with the addition of the relevant collection costs.
Prices
All product sales prices are expressed in Euros and do not include VAT. Shipping costs and cash on delivery collection costs are not included in the purchase price. The total cost of the order including VAT and any other items are indicated and calculated at the conclusion of the purchase process before payment is made. The Customer accepts Magnetall's right to change its prices at any time, however the goods will be invoiced on the basis indicated in the order confirmation email sent by Magnetall to the Customer. In the event of an error of any other nature that may result in a substantial change, not foreseen by Magnetall, in the sales price, the purchase order will be considered invalid and cancelled.
Right of withdrawal
In accordance with the legal provisions in force, the Customer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 days from the date of receipt of the products. The Customer who intends to exercise the right of withdrawal must communicate this to Magnetall by means of an explicit declaration, which may be sent by registered mail with return receipt. The Customer may also exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or alternatively send the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014 (not mandatory) whose text is reported below:

In case of exercising the right of withdrawal, the Customer is required to return the goods within 14 days from the day on which he communicated to Magnetall his intention to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005. The goods must be returned to Magnetall via Caproni 11E/20 Zona Ind.le 38068 Rovereto (TN). The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, etc.) and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, Magnetall will refund the amount of the products subject to withdrawal within a maximum of 14 days. With regard to the return of the product subject to withdrawal, pursuant to art. 56 paragraph 3 of Legislative Decree 206/2005, Magnetall ensures its customers the possibility of using a carrier that has an agreement with it. If the Customer decides to use this service, the shipping costs will be borne by Magnetall. If the Customer intends to use another carrier or another means of shipping, all shipping costs will be borne by him. As provided for by art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, Magnetall may suspend the refund until receipt of the goods or until the Customer has demonstrated that he has returned the goods to Magnetall. Magnetall will carry out the refund using the same means of payment chosen by the Customer during the purchase phase. In the case of payment made by bank transfer, and if the Customer intends to exercise his right of withdrawal, he must provide Magnetall with the bank details: IBAN, SWIFT and BIC necessary for the refund by Magnetall. It is understood that in the event of a product defect, shipping costs will in any case be borne by Magnetall.
Warranty
The warranty is governed by the relevant legal provisions. In the event of receipt of defective products or in any case non-compliant with the orders placed, the Customer has the right to restore the conformity of the product without costs by repairing or replacing the product. In order to exercise the above right, the Customer must proceed with the creation of a return procedure. Magnetall, in the event of a defective or non-compliant product, will, at its own expense, organize the collection of the product, compatibly with the Customer's availability. All products presented on the website www.magnetall.it benefit from the legal guarantee of conformity. To benefit from warranty assistance, the Customer must keep the invoice.
Delivery Methods
The products will be delivered by express courier to the address indicated by the Customer at the time of the order within 1-10 days from the date of receipt by the Customer of the order confirmation email sent by Magnetall. For each order placed on the website www.magnetall.it, Magnetall issues an invoice for the goods shipped. The invoice will be sent by email, after the order has been processed. The invoice will contain the information provided by the Customer during the purchase procedure. After the invoice has been issued, it will not be possible to make any changes to the data indicated in the invoice.
Responsibility
Magnetall assumes no responsibility for disruptions attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the internet network, in the event that it is unable to execute the order within the timeframes set out in the contract.
Access to the website
The Customer has the right to access the website for consultation and purchases. No other use, in particular commercial, of the website or its content is permitted. The elements of this site, whether audio or visual, and the related technology used remain the property of Magnetall and are protected by intellectual property rights.
Cookies
The company Magnetall may use cookies for certain aspects necessary to convey through the site a better idea of its services. Cookies are identifiers that a website can send to the user's browser to track the computer and facilitate the subsequent visit to the site. Cookies are an industry standard and many websites use them. You can set your computer to refuse cookies within the sites or to receive a notification each time a cookie is sent.
Data protection
When initiating, concluding, executing and withdrawing from a purchase contract, we collect, save and process the relevant data in accordance with the relevant legal provisions. When visiting our online offer, the system can record the IP address used by your computer, the date and time, the browser type and operating system of your computer as well as the pages you visit. However, we cannot and do not intend to draw conclusions about your personal data. The personal data that you provide to us, for example when placing an order or by e-mail (e.g. your first and last name and your contact details), will only be processed for the purpose of communicating with you and for the purpose for which you provided us with your data. We only pass on your data to the company entrusted with the delivery of the goods as far as this is necessary for this purpose. For the purpose of processing the payment, we pass on your data to the credit institution entrusted with the payment. We also guarantee that we will not pass on your personal data to third parties unless required by law or unless we have received your explicit prior authorization. If third-party services are required for the execution and performance of product transformation processes, the provisions of Italian data protection legislation apply.
Duration of data storage. Personal data transmitted via our site are stored only until the purpose for which they were communicated has been fulfilled. For data subject to retention obligations for commercial and tax purposes, this duration may extend up to 10 years.
Your rights. If you no longer wish to authorize the storage of your personal data or these are no longer accurate, upon receipt of instructions to this effect we will delete, correct or eliminate your data in accordance with the relevant legal provisions. Upon request, you will receive information on all your personal data in our possession at no additional cost. If one or more provisions of these General Conditions of Sale are considered invalid or declared as such pursuant to the law, regulation or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.
Applicable law and competent court
These General Conditions of Sale are subject to Italian law. Any dispute that cannot be resolved amicably will be subject to the exclusive jurisdiction of the Court of Rovereto. In any case, it is possible to optionally resort to the mediation procedures referred to in Legislative Decree 28/2010, for the resolution of any disputes arising in the interpretation and execution of these conditions of sale.
